Mr. Yoav Bein, Advocate and Mediator

 

Curriculum Vitae

 

Adv. Yoav Bein, from Prof. Bein & Co., has for some time specialized in the developing sphere of unforeseen circumstances and wartime law.

 

Inter alia, Adv. Bein offers representation and advice in the following spheres:

  1. Property tax and compensation fund matters along the green and red track, in consequence of the Second Lebanon War and the situation in the south (Sderot and the Gaza Belt). In such context, property tax claims are filed by various entities through Adv. Bein. Appeals are also filed against property tax decisions. Adv. Yoav Bein also advises various entities.
  2. Various tax concessions, like for example "aerial defence";
  3. The performance of agreements in wartime. For example, is a contractor obliged to continue performing an agreement notwithstanding an unforeseen state of war, or is the tenant of a property liable to continue paying the landlord while fighting is taking place?
  4. The return of cheques without cover and restriction of bank accounts in war time.

 

Inter alia Adv. Bein advises the Haifa and North Chamber of Commerce, including since the war in the north to date on the matter of war damage. He has also advised the Manufacturers Associations on matters relating to the situation in the south (Sderot and the Gaza Belt); volunteered on behalf of the Israel Bar to assist various entities during the Second Lebanon War, for which he was awarded a certificate of appreciation and lectured on war damage in various forums.

 

Adv. Bein has recently been invited to the Knesset Finance Committee, for a discussion on the matter of compensation and the Minister of Finance's regulations on the subject. In consequence of the hearings, approval has been given for a claim for compensation from 11th June to 12th August and in the coming days detailed instructions will be issued in such regard.

 

Adv. Bein recently acted on behalf of Sderot businesses, in conjunction with the Manufacturers Association, to extend the compensation period beyond 4th August 2007 and to extend the deadline for filing claims in respect of the period from 15th May 2007 to 4th August 2007. On 26th February 2008, the Minister of Finance gave notice that he was extending the compensation period beyond 4th August 2007 and at this stage until 12th August, and that he was also extending the deadline for filing claims for those who have not yet filed any claims.

 

Adv. Bein is also acting in conjunction with the Manufacturers Association and other businesses for the purpose of obtaining compensation for the protection means in Sderot and the Gaza Belt. For such purpose, an opinion was prepared in favour of the Manufacturers Association and a decision regarding the compensation and the manner of paying it is pending.

 

Adv. Bein has also appeared before the Knesset in consequence of the Second Lebanon War and brought about an extension in the period during which returned cheques will not be taken into account for the purpose of restricting an account under the Cheques Without Cover Law. Thus, businesses whose accounts have been restricted against their will be able to continue operating. In consequence of the war, Adv. Bein proposed a draft law to amend the Cheques Without Cover Law, to make provision for unforeseen circumstances. At this stage, the draft has passed a preliminary reading.

 

In addition to specializing in the law relating to unforeseen situations (wartime law), Adv. Bein practices very intensively in the law of tenders and in administrative and civil law.
